Section 4 Data Processing Agreement (DPA) – Enterprise Clients
This section applies where Quantum Inno Creat Sdn Bhd acts as a Data Processor on behalf of enterprise clients (Data Controllers) in relation to training, consultancy, or digital services that involve personal data processing.
4.1 Roles of the Parties
- Client: Data Controller – determines purposes and means of processing.
- Quantum Inno Creat: Data Processor – processes data only on client instructions.
4.2 Processor Obligations
- Process personal data only on documented instructions from the client.
- Implement appropriate security measures to protect personal data.
- Ensure staff are bound by confidentiality obligations.
- Assist the client in fulfilling PDPA-related obligations where reasonably required.
- Notify the client without undue delay if a data breach affecting client data is detected.
- Delete or return client personal data at the end of the engagement, unless retention is required by law.
4.3 Sub-Processors
We may engage sub-processors (e.g., cloud providers, CRM/LMS platforms) to support service delivery. All sub-processors are required to follow equivalent data protection standards and contractual safeguards.
4.4 International Data Transfers
Where services involve systems hosted outside Malaysia, personal data may be transferred internationally. We will take steps to ensure that any such transfers provide adequate protection consistent with PDPA principles.
4.5 Data Breach Management
If a data breach relating to client data occurs, we will:
